Terms of Service

These terms apply when you use Broadcastly to send WhatsApp broadcasts. Engaging us for a campaign means you accept them. They're written to be read, not to be skipped — the parts that matter most to you are consent, content and delivery.

1. What we do

Broadcastly sends bulk WhatsApp messages on your behalf. You provide the contact list and the message; we run the campaign and return a delivery report. You choose between sending from a common sender number that we operate, or from a private branded number registered to your business.

We are an independent service provider. We are not affiliated with, endorsed by or operated by WhatsApp or Meta.

2. Your responsibility for consent

This is the most important clause here.

You confirm that everyone on the list you give us has agreed to receive messages from you — because they're your student, parent, customer, member or enquirer, and gave you their number in that context. You are responsible for holding that consent and for being able to show it.

You must not use Broadcastly to message:

We may ask where a list came from, and we may decline a campaign if the answer isn't satisfactory. This protects you as much as us: messaging people who never opted in gets numbers blocked and reported, and a banned number ends the campaign for everyone on it.

3. Your responsibility for content

The message is yours. You're responsible for it being accurate, lawful and not misleading, and for holding the rights to any image, PDF or other material you ask us to send.

4. Platform rules are outside our control

WhatsApp is operated by Meta and sets its own rules for business messaging. Those rules can change without notice, and Meta can restrict or ban a sending number at its discretion — including numbers used for legitimate campaigns.

We take reasonable care to send within platform norms, but we can't guarantee that a number will never be restricted, and we don't control Meta's decisions. If a restriction affects a paid campaign of yours, talk to us and we'll work out a fair resolution.

5. Delivery

We'll make reasonable efforts to deliver your campaign as scheduled. We can't promise every message will be delivered or read, because delivery depends on factors outside our hands: whether the number is valid and active on WhatsApp, whether the handset is online, whether the recipient has blocked the sender, and network and platform conditions.

Your delivery report shows what was actually sent and delivered. Numbers that fail because they're invalid or not registered on WhatsApp count as attempted.

6. Pricing and payment

We quote each campaign individually, based on volume, sender option and how often you send. The quote we give you is what applies to that campaign. Payment terms are agreed at the time of quoting.

Because a broadcast can't be recalled once sent, campaigns that have already gone out aren't refundable. If something goes wrong on our side — we send the wrong message, send to the wrong list, or fail to send at all — contact us and we'll put it right, by re-running the campaign or refunding it.

7. Private branded numbers

If you choose a private branded number, it's registered for your business and used only for your campaigns. You're responsible for how it's used and for the messages sent from it. If the number is restricted by the platform because of the content or the lists sent through it, that's a consequence of your use, not a service failure on our part.

8. Your data and lists

Contact lists you share stay yours. We process them only to run your campaigns and delete them once the campaign and report are complete. See our Privacy Policy for the detail.

9. Limits of our liability

Our liability for any campaign is limited to what you paid us for that campaign. We're not liable for indirect or consequential losses — lost sales, lost admissions, lost goodwill, or business lost because a platform restricted a number.

Nothing here limits liability that can't be limited under Indian law.

10. Ending the arrangement

Either of us can stop working with the other at any time. We may suspend or end service immediately if these terms are breached — particularly the consent and content clauses. Campaigns already paid for and not yet sent will be refunded unless they were the reason for the termination.

11. Changes to these terms

We may update these terms. The date at the top shows the current version, and active customers will be told directly about material changes. Continuing to use the service after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of India, and Indian courts have jurisdiction over any dispute arising from them.
